Terms and Conditions

Service Provider
Company InspectWise Ltd is registered in Finnish company registry (3314503-8). EU VAT registeration number is FI33145038. It is based at Freeport in Hanko Finland. It operates under Finnish and EU laws. Later in this document “we” applies to this company.

Warranty
We provide our services using reasonable skill and vehicle. If we don’t meet the quality level described on our website, you agree to tell us and we’ll work with you to try to resolve the issue.

Liabilities
Our main business is to sell inspection reports of vehicles. When we make an inspection of a vehicle, we are not responsible for the condition of the vehicle or the legality of any paperwork about the vehicle. The liability of any flaw in the vehicle is solely sellers. These terms only limit our responsibility as allowed by applicable law. InspectWise’s total liability arising out of or relating to these terms is limited to the fees that you paid. Each of services is separate. A mistake in an inspection report could allow you to get full refund of what you paid for the report. But mistake on an inspection report will not allow you to get refund from a truck transportation or other service fees.

You´ll indemnify InspectWise and its directors, officers, employees, and contractors for any third-party legal proceedings (including actions by government authorities) arising out of or relating to your unlawful use of the services or violation of these terms. This indemnity covers any liability or expense arising from claims, losses, damages, judgments, fines, litigation costs or legal fees. We are not responsible for any loss of profits, business opportunities, goodwill, or anticipated savings, indirect or consequential loss, punitive damages.

You might find other damages or signs of wear on the vehicle, that were not reported. We are not responsible for any wear on upholstery or interior trim such as small scratches, discoloration, small cracks or stains up to 2.5 cm. Signs of wear on entry or exit areas, rubber seals and cover panels. We are not responsible for any repairs that cost you less than 350 €. This applies to all damages separately. And this applies to any technical or mechanical issue that was hidden during the inspection. For damages that cost you more than 350 € to repair, and were undoubtedly on the vehicle during the inspection and should have been noticed by the inspector (did not appear later during the transport etc), we are willing to return the inspection payment. But we limit our responsibility to the maximum amount that was paid for the inspection.

We might include estimations of government fees or taxes on our offers. We are not responsible for any loss caused by our calculations. The fees might change, we can make an error or the government official might make an error. The final fees and taxes might be much more than we estimated. We don’t take any responsibility for the loss caused by our wrong estimation in any situation. In the end you are responsible to find out exactly the fees that you need to pay to your home country to get the vehicle registered.

This same applies to a situation when you are not able to register a vehicle. We are never definitely sure if a vehicle will pass all technical requirements in your country. We know a lot about EU laws, importing and exporting. We are happy to share all of our knowledge. But still we are not responsible for any damages in a situation that you can’t get a vehicle registed.

What we expect from you?
Don’t buy a vehicle remotely without our help. Even if you have received our inspection report, it doesn’t mean that the deal would be safe. We are not responsible for any damages or losses you face in buying a vehicle remotely yourself. Remember that we have an open platform for agents and because vehicles are expensive this industry is of interest to criminals. Someone might try to use our platform to commit illegal acts. We allow only our Certified Expert Partners (later CEP) to do vehicle deals on your behalf. Vehicle deals done by CEP are 100% secured by our company. We have an insurance that can cover losses caused by fraud or scam up to 200,000 €. Please report to us if a lower level agent is asking you to pay for a vehicle to a dealer, to him or to another person. Never send money requested by a lower lever agent. You can check the level of the agent on our website.

Making a remote vehicle deal with CEP
You will buy the vehicle based on the inspection report remotely. We will buy the vehicle and then sell it to you. For these vehicles our company is reliable as a used vehicle dealer in EU. We secure the deal 100%. You receive the vehicle and it is registered to your home country or you get your money back.

You need to pay the vehicle and all our services before we deliver the vehicle to you. In some countries this applies also to the government registration fees and taxes that will be collected by us.

Most often we only sell vehicles with a mechanical guarantee from a third party. In Finland we sell and secure the vehicle with services provided by InSure Group. If client has technical problem we advise to be in contact with this insurance company to sort out the payment.

Our liability for errors is limited to the assumed life span of different parts of the vehicle.
- Engine 300,000 km
- Gearbox and transmission 200,000 km
- Other main equipment (starter, charger, a/c) 150,000 km
- Electronics, 4 years

Your responsibility is to maintain vehicle by doing the services in time as guided by the manufacturer.

If there is any problems in the vehicle, please contact us immediately. We will guide you to a place where the problem can be fixed.

InspectWise is not responsible for any faults caused by the lack of maintenance, not repairing a minor fault or using the vehicle in a wrong way. InspectWise is not responsible for any extra damages caused by the client when using the vehicle after a minor fault or noise should have been noticed.

Each vehicle has parts that wear in use. InspectWise is not responsible for these wearing parts, for example: particulate filter, brakes, clutch, shock absorbers, bearings, joints and battery.

Crime insurance
Finland’s biggest financial institution OP-Pohjola has given InspectWise an insurance against any loss caused by scam or fraud. This is why we can promise an extensive security for any vehicle deal that is done through our company. This insurance covers losses caused as a result of a property offence. Terms & conditions of this insurance are in accordance with the Penal Code of Finland. The insurance covers the offences in their petty, ordinary and aggravated forms. It will cover losses caused by the following offences: embezzlement, fraud, forgery, counterfeiting, data processing fraud (under Penal Code, Chapter 36, subsection 1), misuse of a position of trust, extortion, any other property crime criminalized in the Penal Code of Finland committed with the intention of illegally gaining a financial advantage to oneself or a third party and causing financial loss to the insured.

This insurance is valid only for vehicles bought through InspectWise Ltd. Buying a report from InspectWise does not activate this insurance.

Valid in (area): When vehicle is bought from ETA-counties (EU, Norway, Iceland and Switzerland) and it can be exported to anywhere in the world. Not available for vehicles bought from other countries.

Ammount: coverage is 100 % of payments made for InspectWise about a specific vehicle. Maximum amount is € 200,000. Any deductible paid by our company (loss not covered by the insurance) will not be charged from our clients in any circumstances.

In compensation situations, the amount of loss must be assessed by an auditor or a comparable external expert. Ultimately, a court of law confirms the amount of loss.
Insurance doesn’t cover indirect loss or damage, such as loss of, or failure to receive, income, profit, interest, dividend, payment or equivalent asset.
As soon as the loss is detected, efforts must be made to limit the loss occurred and eliminate the cause of the loss. Any evidence concerning the crime, the offender and the amount of criminal damage must be secured.

The loss must be reported as soon as possible once information of the loss has been received or the claim has been made. A loss report does not have
to be filed in a specific format. You can do it through our website or Internet Service. The loss report should be made with care in order to ensure maximum speed and correctness in the processing of the claim. A loss report must be made within one year of the loss being discovered.

Full comprehensive vehicle insurance
Finland’s biggest financial institution OP-Pohjola has given InspectWise a comprehensive insurance that is automatically valid immediately after a vehicle is paid and picked up from the seller. This insurance doesn’t require any registration for the vehicle in any country. It is valid without registration. Any vehicle bought from InspectWise is fully covered by this comprehensive insurance until it is delivered to the client.

This insurance is valid only for cars bought through InspectWise Ltd. Buying a report from InspectWise does not activate this insurance.

Valid in (area): Everywhere in Europe (except the Russian areas outside of Europe). This insurance can be sold separately for cars bought from other countries or for the exporting to other countries outside Europe.

Amount: coverage is 100 % of payments made for InspectWise about a specific vehicle. There is no limit for maximum coverage. Any deductible paid by our company (loss not covered by the insurance) will not be charged from our clients in any circumstances.

Insurance is valid for 14 days after the car is taken into the transport in the origin country. It ends when the vehicle is delivered to the final destination you have specified.

This insurance is valid when the car is parked, waiting for the transport, in the transport (truck or shipping) or driven by anyone.

We will cover your vehicle, if it gets stolen. You will also receive compensation if the paint of on your car gets scratched or for other malicious damage. We also cover fire damage caused by a fire or by thunder.

We cover dents caused your parked care by an unknown motor vehicle without any bonus reduction.

Normally vehicle is not driven before it is delivered to our client but if during the transport the car is driven the following coverage is always valid.
We cover an accident that occurs abroad, even if the driver of your vehicle is personally liable towards third parties.
If the driver will run into an elk, a deer, or any other animal with your vehicle, we cover the damage to your vehicle.

Transportation
Any transportation arranged or done by our company is under the regulations of the CMR Convention. We use CMR waybill developed by the International Road Transport Union. Our insurance coverage for transports within Europe is comprehensive, way beyond the CMR-minimum requirements (kg based compensation in a case of total-loss). For the first 14 days after the vehicle pickup it is fully insured with no limit in the compensation (vehicle price) as explained above in this document.

Any transport outside Europe is covered by the minimum CMR insurance ($ 8.33 / kg) . We can make you an offer of comprehensive insurance.

Taking action in case of problems
Before taking action as described below, we’ll provide you with advance notice when reasonably possible, describe the reason for our action, and give you an opportunity to fix the problem, unless we reasonably believe that doing so would:
- cause harm or liability to a user, third party, or InspectWise
- violate the law or a legal enforcement authority’s order
- compromise an investigation done by authorities
- compromise the operation, integrity, or security of our services

If we reasonably believe that any of your content breaches these terms, violates applicable law, or could harm our users, third parties, or InspectWise, then we reserve the right to take down some or all of that content in accordance with applicable law. Examples include child pornography, content that facilitates human trafficking or harassment, and content that infringes someone else’s intellectual property rights.

Suspending or terminating your access to InspectWise services
We reserves the right to suspend or terminate your access to the services or delete your account if any of these things happen:
- you materially or repeatedly breach these terms
- we’re required to do so to comply with a legal requirement or a court order
- we reasonably believe that your conduct causes harm or liability to a user, third party, or InspectWise — for example, by hacking, phishing, harassing, spamming, misleading others, or scraping content that doesn’t belong to you
- Of course, you’re always free to stop using our services at any time. If you do stop using a service, we’d appriciate knowing why so that we can continue improving our services.

Return Policy of remote sales in EU
This section applies to vehicles you buy through our company by one of our CEPs. For private clients within EU we give a 14 days right to return. The following terms apply in a situation when a private EU citizen has bought a vehicle without seeing it from InspectWise Ltd (based on our inspection report) and it is registered to any EU country before the delivery.

They have the right of returning the vehicle even if it doesn’t have any fault in it. These terms do not apply if client has seen the vehicle at one of our official service locations before deciding to buy it.

The return can be made if these terms are fulfilled
- Vehicle was bought 100% for private use (not for sale, taxi, competition in sport, commercial use etc.).
- Client is in contact with us before he makes the return
- Client will return the vehicle to the exact location from where he picked it up
- Client has not driven over 50 km with the vehicle. On remote sales we need to give client the opportunity to test the vehicle as he could do when buying similar vehicle from a vehicle dealer. We think that a 50 km drive is enough to be compared with a test drive at a vehicle dealer.
- Client is willing to compensate the impairment for each day he has used the vehicle (0,1% of the vehicle sales price for each day).
- When you make a remote vehicle deal with InspectWise based on our inspection report, the freight term is always FOB (unit in original location, client needs to arrange the collect and transportation). This applies also if you decide to buy our transportation services. You will buy the vehicle in its original location. This is why we never return any payments of truck transportation.
- We don’t return the inspection cost or any registration fees or any other fees related to the delivery of the vehicle.
- If the vehicle was sold on a vehicle loan, there might be some fees from the bank. Client is responsible for all bank fees.
- The vehicle must be returned in exactly the same condition as it was when it was sold. Any cleaning or repair fees are deducted from the refund.
- Client needs to make sure he returns everything he got with the vehicle, for example: registration documents, manuals, service history leaflet, second set of tires, charging cables, keys etc
- Vehicle will be inspected together with the client when returned.
- Payment will be returned within three weeks.

In a case of disagreement
Any serious reclamations will be handled by our CEO Tomi Rantanen (tel. +358 44 3677 990 name@inspectwise.net) . We always want to settle matters by negotiating with you. If we can’t settle in negotiations between us, we advise you to contact the Finnish Consumer Disputes Board. Or your local EU consumer officials. Any court case against us must be handled by the district court in Ylivieska Finland.

About these terms
By law, you have certain rights that can’t be limited by a contract like these terms of service. These terms are in no way intended to restrict those rights. These terms describe the relationship between you and InspectWise. They don’t create any legal rights for other people or organizations, even if others benefit from that relationship under these terms.

We want to make these terms easy to understand, so we’ve used examples from our services. But not all services mentioned may be available in your country. If it turns out that a particular term is not valid or enforceable, this will not affect any other terms.

If you don’t follow these terms and we don’t take action right away, that doesn’t mean we’re giving up any rights that we may have, such as taking action in the future. We may update these terms (1) to reflect changes in our services or how we do business — for example, when we add new services, features, technologies, pricing, or benefits (or remove old ones), (2) for legal, regulatory, or security reasons, or (3) to prevent abuse or harm.

If we materially change these terms or service-specific additional terms, we’ll provide you with reasonable advance notice and the opportunity to review the changes, except (1) when we launch a new service or feature, or (2) in urgent situations, such as preventing ongoing abuse or responding to legal requirements. If you don’t agree to the new terms, you should remove your content and stop using the services. You can also end your relationship with us at any time by closing your InspectWise account.

Other than the rights and responsibilities described in this section (in case of problems or disagreements), InspectWise won’t be responsible for any other losses.


Additional terms related to VIN reporting

1. The collection of data required for reporting will begin after the user has successfully paid for their order. The user is responsible for the correctness of the VIN code provided by him/her. If the user does not have a VIN code, data collection will start when the seller has provided the vehicle's VIN code. In this case, we are not responsible for the correctness of the VIN code provided by the seller.

2. Due to the international data sources used for reporting, we do not guarantee that the reporting data will always be up-to-date or equally comprehensive for each vehicle. The amount of information to be reported may vary due to country-specific practices (not all countries publish the same amount of information; force majeure). The same variation may exist between vehicle manufacturers.

3. The user is responsible for the decisions he or she makes based on the information in the report, such as whether or not to purchase the vehicle. The information presented in the report is therefore not a recommendation to purchase, nor should it be construed as, for example, an offer or other requirement.

4. The user may not sell or otherwise use the report for trading purposes (directly or indirectly).

Payment Service Provider
Paytrail Plc acts as a collecting payment service provider and is an authorized Payment Institution. Paytrail Plc will be shown as the recipient on your bank or credit card statement. Paytrail Plc will forward the payment to the merchant. For reclamations, please contact the website the payment was made to.
